Purchase Agreement

This Service Purchase Agreement (“Agreement”) sets forth the terms and conditions governing the purchase and use of services offered by Cercme (“we,” “us,” or “our”), a cloud-based CRM platform designed for business and sales productivity. By purchasing a subscription, license, or any other service from Cercme through our website or authorized resellers, you (“you” or “Customer”) agree to be bound by the provisions of this Agreement, which is effective as of the date of purchase or subscription.

Our services are provided on a subscription basis, and access to the platform is granted upon successful payment. Subscriptions may be offered on a monthly, annual, or customized billing cycle. Prices for each subscription tier are clearly presented at the time of purchase and are subject to change at our discretion. Any changes to pricing will be communicated in advance and will not affect active billing periods unless expressly stated.

You are responsible for providing accurate and up-to-date billing information at the time of purchase. By submitting payment information, you authorize Cercme to charge your selected payment method for the applicable fees and taxes associated with your subscription. Unless otherwise specified, subscriptions are set to renew automatically at the end of each billing cycle. You may cancel your subscription at any time through your account settings, and access will remain active through the end of the current paid period. No refunds or partial credits will be provided for mid-cycle cancellations unless otherwise required by applicable law.

All services purchased are licensed, not sold. You are granted a limited, non-exclusive, non-transferable right to access and use Cercme’s platform for internal business use only. You may not sublicense, resell, reverse engineer, or use the platform in a way that violates applicable laws, intellectual property rights, or the terms of this Agreement. Cercme retains full ownership of all software, tools, and related content made available through our services.

Cercme reserves the right to suspend or terminate access to the platform if payment fails, the account is in violation of this Agreement, or there is evidence of abuse, misuse, or fraudulent activity. We will make reasonable efforts to notify you prior to such actions and may provide a grace period for resolution at our discretion.

We may offer trial periods, discounts, or promotional offers that alter the standard terms of purchase. Any such variations will be disclosed at the time of offer and are subject to this Agreement. Trials that convert into paid subscriptions will be billed automatically unless canceled before the end of the trial period. Additional services or add-ons requested after the initial purchase will be subject to separate fees and may have their own terms.

All purchases are final unless otherwise stated. We do not offer refunds except in cases where service was not delivered as described or as required by consumer protection laws. In the event of any service interruption, Cercme is not liable for indirect, incidental, or consequential damages. We are committed to maintaining platform uptime and performance, but we do not guarantee uninterrupted access.

You acknowledge that it is your responsibility to maintain secure access to your Cercme account. Cercme is not liable for any loss or damage arising from unauthorized access resulting from your failure to secure your login credentials.

This Agreement is governed by the laws of the jurisdiction in which Cercme is headquartered, without regard to its conflict of laws principles. Any disputes arising under this Agreement will be resolved through arbitration or courts located in that jurisdiction, unless prohibited by applicable law.

By purchasing any service, software, or subscription from Cercme, you confirm that you have read, understood, and agree to this Service Purchase Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.
